Welcome to the Mii website. This website is owned and operated by Gerrard International Ltd, a company registered in England and Wales (Registration No 02691027). Our registered office is 47 Theobald Street, Borehamwood, Hertfordshire, WD6 4RT, UK.

1. OUR AGREEMENT

These Terms and Conditions (the “Terms”) are the terms that apply when you use the website www.miicosmetics.com (the “Website”). Any reference to ‘’Mii’’/’’Mii Cosmetics’’/“we”/”us”/”our” in these Terms is a reference to Gerrard International Ltd (owner of Mii Cosmetics and miicosmetics.com) and any reference to “you” or ”your” means you, the user of the Website. By accessing this Website, browsing, completing your customer registration with us and/or when you place an Order on the Website you will be deemed to have read, understood, and agree to be bound by these Terms. Please read these Terms and Conditions carefully before using the Website or placing an Order with us.

These Terms and Conditions should be read alongside, and apply in addition to, our Privacy & Cookies Policy.

2. CHANGES TO TERMS

We reserve the right to add, change, or modify these Terms at any time without notice including for legal, regulatory or security reasons. We will post the changes to these Website Terms on this page and will indicate at the top of this page the date these Terms were last revised. We encourage you to review the Terms in advance of placing any Orders. Every time you place an Order with us, the Terms in force at the time of your Order will apply to the contract between you and us. Any changes made after you have placed an Order will not affect that Order unless we are required to make the change by law. If you do not agree to any of the Terms please stop using the Website. If you have any questions, concerns, or comments about our Terms please contact our Customer Care team via email or telephone.

3. USE OF THIS SITE

3.1 By accepting the Terms you confirm that all information and details provided by you to us (including on registration) are true, accurate, and up to date in all respects and at all times. Should any of your registration information change, please notify us immediately. By ordering any products on our Website, you confirm that you are: (i) a resident of the United Kingdom; (ii) ordering products for delivery in the United Kingdom; and (iii) 18 years old or over.

3.2 You agree that in using the Website you will not: (i) use the Website in any way that causes, or is likely to cause the site or access to the site to be interrupted, damaged, or impaired in any way; (ii) use the Website for any purpose that could damage the name of Mii or any goodwill attached to the Website; (iii) use the Website for criminal, fraudulent or illegal activity or in any manner which would cause harm or distress to any third party; (iv) access or attempt to access the accounts of other users or attempt to penetrate the Website security measures; (v) use the Website for any purpose other than your personal use; nor (vi) reproduce, duplicate, copy, sell, resell or exploit any portion of the Website without express written permission by us.

3.3 We reserve the right to suspend, restrict or terminate your access to the Website at any time without notice if we have reasonable grounds to believe that you have breached any of these restrictions or if we suspect fraudulent account activity or behaviour. This shall not limit our right to take any other action against you that we consider appropriate.

3.4 Our Website may contain links to other websites, applications, or resources. We have no control over the content of such websites and shall not accept any responsibility or liability in any way for their content.

3.5 Whilst we endeavour to ensure the accuracy of any information we place on the Website, we make no warranties (whether express or implied) in relation to its accuracy. All product descriptions and images displayed on the Website are provided in good faith but are intended to be as guidance only. Whilst we have taken every effort to ensure colours display accurately, we are unable to guarantee that the display of colours on your device accurately reflects the colour of the products.

3.6 Whilst we will take all reasonable steps to ensure a fast, uninterrupted, and reliable service, we do not guarantee that your use of this Website will be interruption or error-free and we will not be responsible or liable for any disruption, loss of, corruption or material degradation in transit, or loss of, or corruption of material or data when downloaded onto any computer system.

3.7 Any content that you upload to the Website or which you send to us via any other medium (including social media) will be considered non-confidential, non-proprietary and we will have the right to use, copy, distribute, and disclose to third parties such material for any purpose. You will agree not to engage in transmitting, uploading, posting, emailing, or otherwise making available on the Website user content that infringes any rights of any third party or is: unlawful; harmful; threatening; abusive; harassing; defamatory; vulgar; obscene; pornographic; libellous; invasive of another’s privacy; hateful, nor racially, ethnically or otherwise objectionable.

3.8 The review feature is available on the understanding that product reviews will be posted in good faith based on a user having trialled a product, to offer a helpful and truthful opinion of the product. All reviews are subject to approval and by submitting a review, it is not guaranteed to appear on the Website. You agree to not transmit, upload, post, or email any content that is false, inaccurate or misleading.

3.9 This Website is not intended for children and we do not knowingly collect data relating to children.

4. REGISTERING FOR AN ACCOUNT

4.1 To save time when ordering products from our Website, we offer you the opportunity to register for a personal account. To register, you must supply us via the online registration form with the following information: your full name, password, and email address. Billing and delivery addresses can be added once registered. Once you click on the ‘Register’ button this information will be stored. You can access, update, or correct your personal account details via the ‘Account’ icon. We will only use the stored data in accordance with our Privacy Policy.

4.2 You are responsible for maintaining the confidentiality of your password and account details and are responsible for all activities that are carried out under them. We do not have the means to check the identities of people using the Website and will not be responsible for losses suffered by you where your password or user name is used by someone else unless this is due to our negligence. You agree to notify us immediately by emailing info@miicosmetics.com or via telephone at 0345 217 1360 if you suspect any activity on your account that is not carried out by you.

5. ORDERS

5.1 By placing an Order via our Website you are making a contract for purchase on the Terms and Conditions set out in these Terms.

5.2 The steps for placing an Order and creating a contract of sale between you and us are as follows:

  • Once you have found a Product on the Website that you would like to purchase, click on the button ‘ADD TO BAG’. This will add your Product to a virtual ‘basket’. You can then proceed to pay for the Product(s) in your Basket by clicking on the Basket icon and then clicking ‘CHECKOUT’. Alternatively, if there are further items you would like to purchase you can continue browsing the Website and add additional items to your Basket.
  • You can view what Products are in your Basket at any time by clicking on the Basket icon. If you wish to remove a Product from your Basket, simply click on ‘Remove’ next to the quantity for the relevant Product. You can continue to pay for the Products in your Basket at any time by clicking the button labelled ‘SECURE CHECKOUT’.
  • When you click the ‘SECURE CHECKOUT’ button you will be given the option to Sign In or Register. If you do not wish to Sign In or Register you can proceed as a guest. You will then be asked to provide information necessary to process your Order and deliver the Product(s) to you. You can provide this information by filling in the fields requested on the screen. All fields with an asterisk must be completed. We respect your right to privacy and will only use any information you provide to us in accordance with our Privacy & Cookies Policy.

5.3 Once you have placed an Order, you will receive an email confirming receipt of the Order. This email will include your order number and details of the items you have ordered. We would suggest that you keep a copy for your own records and check for accuracy. This email does not constitute our acceptance of your Order; it merely records the fact that we have received your Order. If you do not receive a ‘Confirmation Email’ please contact our Customer Care team via email or telephone. You will receive a further email from us once the Order has been dispatched from our warehouse. Our acceptance of your Order and the completion of the contract between you and us will take place when we have dispatched the Products to you.

5.4 Products are subject to availability and whilst we do our best to ensure the correct availability is displayed on the product page, we may on occasion need to cancel an item from an Order if the stock position of a Product is inaccurate. If a Product becomes unavailable between the time you have placed the Order and we accept the Order, we shall notify you as soon as possible and you will not be charged for the out-of-stock item.

5.5 If we are unable to accept your Order, we will notify you of this and you will not be charged for your Product(s). This might be due to: (i) a Product you ordered is out of stock; (ii) we are unable to obtain authorisation for your payment; (iii) we have identified an error with the price or product description; (iv) there are restrictions (legal or otherwise) or practices in relation to a Product which prevent us from being able to sell or deliver it to you; or (v) unexpected limits on our resources.

5.6 Items that are placed in your shopping basket are not reserved and may be purchased by other customers.

5.7 We are committed to getting your Order to you as quickly as possible, and in most circumstances, we may not be able to amend or cancel an Order once the status of an Order has changed to ‘processing’. If you do need to change or cancel an Order please contact our Customer Care team via email or telephone as soon as possible. We will let you know if the change is possible, any changes to the price as a result of the change and ask you to confirm whether you wish to proceed with the change.

6. PAYMENT

6.1 Online payment will be provided in a secure environment. We accept payment for Orders by Clearpay, Maestro, MasterCard, Visa, Visa Debit, PayPal, Apple Pay (must be set on device), Google Pay (must be set up on device) and digital gift cards.

6.2 All card payments are subject to authorisation by your card issuer. In the event that your payment is not authorised, we will cancel your Order and notify you of the cancellation via email. We will not be liable for any delay or non-delivery.

6.3 Payment will be debited and cleared when your Order is placed.

6.4 You confirm that your credit/debit card or payment account that is being used is yours or that you have been specifically authorised by the owner of the same to use it.

6.5 Fraudulent use of credit cards will be reported to the relevant authorities.

6.6 In cooperation with Clearpay we offer you the option to pay in 4 interest-free installments. Visit the Clearpay website here for a detailed list of FAQs. Your personal data is handled in accordance with applicable data protection law and in accordance with the information in Clearpay’s Privacy Policy.

7. DIGITAL GIFT CARDS AND VOUCHER/PROMOTION CODES

7.1 Digital gift cards are redeemable online at miicosmetics.com only.

7.2 There is a two-year expiration date, from the date of purchase, on all digital gift cards.

7.3 We are unable to cancel, amend, exchange for cash, or refund any digital gift card. If you lose or delete your digital gift card number, please contact our Customer Care team via email or telephone.

7.4 If the Products purchased online total less than the value of your gift card, any balance will be left as credit for you on your gift card. You may check the balance of your gift card on your account by logging in and selecting the “Gift Card” section. Alternatively, please contact our Customer Care team.

7.5 Unless stated only one voucher promotional code can be redeemed per transaction and can not be used in conjunction with any other offer including sale or bundle items.

7.6 Please take care when entering codes as they are case and space sensitive.

8. PRICE

8.1 The price of a Product will be displayed when placing an Order, and is in pounds sterling and inclusive of Value Added Tax (VAT). Prices do not include other taxes that may be applied in your jurisdiction and do not include delivery charges, which will be added to any Order you place.

8.2 Whilst we try to ensure that all prices on our Website are accurate, errors may occur and we reserve the right to alter prices at any time. If the price of your Product(s) changes after you have ordered, we will not be able to refund/credit you the difference in price (this also includes sale price adjustments). If we discover an error in the price of a Product you have ordered, we reserve the right to not accept your Order and shall contact you as soon as possible to give you the option of either reconfirming your Order at the correct price or cancelling your Order. If we are unable to contact you, we reserve the right to treat your Order in respect of the incorrectly priced Product as cancelled and we will refund to you the relevant part of the Order.

9. DELIVERY

For further information on delivery including shipping costs and estimated delivery times please see the Delivery & Returns Policy.

9.1 We are proud to offer free 3-5 day delivery on all UK orders of £30.00 and over. Depending on the parcel size, weight, content and destination, delivery is made by Evri or a suitable courier partner. Some parcels may require a signature on delivery.

9.2 If no one is available at the address at the time of delivery, depending on the courier the Product(s) will either (i) be retained by the delivery company for a reasonable period of time and then returned to us; (ii) be attempted to be delivered to a neighbour or they’ll be available to collect from your local delivery office or pickup location; (iii) be attempted to be automatically redelivered on another working day; or (iv) you may be able to reschedule the delivery on a day that suits you. If an Order is returned to us by the delivery company, we will issue you with a refund for the Product(s) but reserve the right to retain any costs incurred in arranging for the delivery and return of the Order.

9.3 At the point of placing an Order you must provide us with complete and accurate delivery and billing address information. If you provide inaccurate or incomplete delivery information, we will not be liable for failure to deliver your Order. We are unable to redirect packages once an Order has been processed.

9.4 We aim to process most Orders received before 1pm the same working day, Monday through Friday, excluding bank holidays, subject to your payment being processed and stock availability. Orders placed after 1pm, on Saturday or Sunday or on a bank holiday will be processed the following working day. Please note that during sale or other busy periods delivery of your Order may take longer. While we will endeavour to have your Products to you as quickly as possible, please allow 5 working days from placing your Order to receipt of goods for orders with a UK delivery address.

9.5 All risk in the Product(s) you Order (including risk of loss and/or damage to the Products) shall pass to you upon delivery to you.

10. CANCELLATION & RETURNS

We hope you are delighted with your online Order but if for any reason you do need to return something to us, please see our Delivery & Returns Policy for more information.

10.1 You have a statutory right to cancel your contract of sale at any time up to fourteen (14) days after the day on which you receive your Order. You need to return the item(s) within fourteen (14) days after the day on which you receive your Order to receive a refund. As we are committed to getting your Order to you as quickly as possible, in most circumstances, we may not be able to amend or cancel an Order once the status has changed to ‘processing’. If you have made an error, please contact our Customer Care team via email or telephone as soon as possible. If your Order has already been shipped, you will need to return the item(s) following our Returns Process in the event of any unwanted products. Please ensure that any unwanted goods are returned in their original, pristine condition.

10.2 If you choose to cancel/return your Order within 14 days from delivery, we will refund you in full including the original cost of delivery. You will have the responsibility for covering the costs of the return of unwanted goods.

10.3 Only items purchased on miicosmetics.com may be accepted for return or exchange.

10.4 If you are returning an item for a reason other than damaged, faulty or incorrect product, you will have the responsibility for covering the costs of the return. We recommend the goods are adequately packed for protection and that you ship using an insured, trackable service to ensure a safe and prompt return. Please retain a copy of your proof of postage when you return the goods to us. In the unlikely event, we do not receive the returned parcel, carriers require that you file the tracer or claim. We cannot be held responsible for returns lost in transit.

10.5 If the product delivered is not what you ordered, is damaged, or of an unsatisfactory quality, Mii will supply a replacement product or refund the price paid and a reasonable cost for returning the product.

10.6 Products purchased as a set or a bundle can only be returned as a complete set, not as individual items.

11. REFUNDS

11.1 If you have changed your mind and cancel your Order within fourteen (14) days of us receiving your Order back by post, we will refund the original purchase price for your Order plus the original cost of delivery provided that you return the Product(s) to us in a saleable condition.

11.2 We will not refund postage costs for returning any unwanted products. If you are returning damaged, faulty, or incorrect items we will happily refund a reasonable cost for returning the products back to us.

11.3 We may make a deduction from the refund if the goods have not been returned in their original, pristine condition or if reasonable care has not been taken to protect the returned goods from damage. In such circumstances, we shall notify you of the reduced amount due to be refunded.

12. VIP SCHEME

12.1 The Mii VIP scheme and benefits are operated by Gerrard International Ltd for UK Spas and Salons only. Gerrard International can cancel, withdraw, or alter the scheme at any time, including these Terms and Conditions or any individual VIP account.

12.2 The VIP scheme is for personal use only for UK customers; business use is strictly prohibited and constitutes abuse. Gerrard International can take any action it considers appropriate, including removing or suspending a Mii VIP account and any benefits accrued if we have reason to believe you are abusing the scheme.

12.3 The VIP discount does not apply to any other offers, sale items or special-priced sets or bundles. The unique discount code needs to be entered at the checkout every time an Order is placed online at miicosmetics.com otherwise discount will not be applied.

12.4 The free gift benefit for new VIPs is subject to availability and meeting the specified spend threshold.

12.5 If you are a Spa or Salon requiring further information on the VIP Scheme contact vip@miicosmetics.com.

13. PROFESSIONAL DISCOUNT

13.1 Membership to MII PRO is currently only available to makeup artist professionals and professional makeup students in the U.K. By participating in the PRO programme you agree to these Terms and all Terms incorporated and you acknowledge that you have read and understood the Privacy & Cookies Policy. If you do not agree to these Terms, please contact us immediately by emailing miipro@miicosmetics.com, and we will remove you from the PRO programme.

13.2 You must be a makeup-accredited professional or a beauty student aged 18 and over to apply. In order to be accepted into the programme you must fulfill the PRO requirements, submit the required documentation and successfully complete the online application form found here. You may contact miipro@miicosmetics.com to confirm your application was received, but please allow up to two (2) weeks for processing. We reserve the right to reject applications for any reason.

13.3 As a PRO member you will be entitled to up to 30% discount off products purchased online at miicosmetics.com. You will need to apply your unique PRO member code at checkout each time you shop with us to obtain your discount. The code cannot be used in conjunction with any offers and cannot be used against sale items, bundle offers or the digital gift card. The discount lasts for 24 months from the date you are accepted into the programme or until you cease to be eligible to be a member.

13.4 The membership discount may only be used by the individual to whom the membership is issued and may not be shared with others under any circumstances. In the event that the PRO membership code is used in a manner that violates programme guidelines, we reserve the right to cancel the membership, render the code inactive, and revoke membership privileges. We reserve the right to modify the programme, and its benefits or limit member purchases at any time without prior notice.

13.5 Products purchased by PRO members using the discount benefit are for the members’ personal and professional use only and may not be resold under any circumstance.

13.6 We reserve the right to verify your continued eligibility or revoke your membership and may amend the PRO requirements at any time. In the event that your circumstances change, and you no longer fulfill the criteria to qualify for the PRO Programme (for example, you cease to be a professional makeup artist or makeup student) you must notify us immediately via email at miipro@miicosmetics.com and we retain the right to end your membership. In the event that the application, or any accompanying information, is invalid or incorrect or where we have reason to believe that the discount has been used in a manner that violates programme guidelines, we reserve the right to cancel the membership, render the code inactive, and revoke membership privileges.

13.7 When completing the online application form professional makeup artists must provide ONE of the following photo identification (photo or scanned):

  • Current Passport
  • Current Driving License
  • Current National Identity card

Professional makeup artists must also provide:

  • Copies of certificates or diplomas for all makeup artistry courses attended
  • Images of work (2 minimum)

Plus ONE of the following (photo or scanned document):

  • Call sheet with name credit
  • Editorial page/press material with name credit
  • Proof of insurance for makeup artistry
  • Active social media page featuring makeup content

 

When completing the online application form makeup students must provide ONE of the following photo identification (photo or scanned):

  • Current Passport
  • Current Driving License
  • Current National Identity card

Makeup students must also provide:

  • Enrolment letter or letter from the college detailing proof of attendance and the makeup artistry course name

Plus ONE of the following (photo or scanned document):

  • Student card
  • Active social media page featuring makeup content

13.8 The personal data which you provide when you apply to become a PRO member is necessary to allow us to assess whether you are eligible to join the programme. If you are successful, the personal data is also necessary for us to enter into an agreement to register you as a PRO member and in order to complete your registration and to administer the PRO programme in accordance with our Terms and Conditions. This will include using your email address to let you know whether your application to become a PRO member has been successful and, where necessary, to provide you with further information about the PRO programme.

13.9 PRO members may return products in accordance with the Terms and subject to the limitations of the return policy guidelines.

14. INTELLECTUAL PROPERTY

14.1 Your use of the Website grants no rights to you in relation to copyright, design rights, trademarks, or other intellectual property rights (or the intellectual property rights of third parties).

14.2 All text, graphics, photographs, databases, logos, trademarks, artwork, videos, animations, user interfaces, visual interfaces, and computer code (the “Content”) belongs to Gerrard International Ltd (or is licensed to Gerrard International). You are not permitted to copy, reproduce, republish, upload, post, publicly display, link, translate, transmit, or distribute this Content or pass it off as your own, or otherwise use it in any way without our prior written permission.

14.3 You agree and acknowledge that the material within this Website is made available for your personal and non-commercial use only.

15. LIABILITY AND INDEMNITY

15.1 You have certain rights under the law as a consumer, including Product(s) supplied to be of satisfactory quality and fit for their intended purpose. For more information about your statutory rights contact your local Citizens Advice Bureau or Trading Standards Office. Nothing stated within these Terms affects these legal rights, and we will perform our obligations under these Terms and Conditions with reasonable care and skill.

15.2 If you receive any Order(s) or Product(s) of unsatisfactory quality, you can: (i) contact us for a full refund within thirty (30) days of delivery, or (ii) contact us for a replacement.

15.3 We will not be liable for any damages of any kind arising out or in connection with the use of this Website or in connection with any Order placed by you. This limitation of liability applies to all damages of any kind including but not limited to direct, indirect, incidental, punitive, or consequential damages, loss of data, income or profit, loss of or damage to property, and claims of third parties. Our total liability (whether in contract, tort, negligence, or on any other basis) to you, for any loss or damage shall be limited to the sums paid or payable for the Product(s).

15.4 We will not be liable to you where we breach these Terms and Conditions due to any cause that is beyond our reasonable control.

15.5 Nothing in these Terms and Conditions shall limit our liability for death, fraud or personal injury resulting from our negligence.

16. GENERAL

16.1 We may change these Terms and Conditions at any time without notice.

16.2 If any of these Terms are deemed to be unlawful or void by any court or regulator, then that clause shall be deemed severable, but all the other Terms shall continue to apply.

16.3 We will not be held responsible to you for any delay or failure to comply with our obligations under these Terms if the delay or failure arises from any cause beyond our control.

16.4 The Website may only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations.

16.5 These Terms are governed by English law and are subject to the exclusive jurisdiction of the English courts.

17. COMPLAINTS

If you have any comments or wish to complain about any matter, please contact our Customer Care team via email or telephone. We will always endeavour to resolve any dispute as swiftly as possible.

18. DATA PROTECTION

We take the protection of your personal data/information very seriously and we know that it is important for you to understand what personal information we collect and how we use it. 19. REVIEW PRIZE DRAW

19.1 When placing an online order with us, you will be invited to take part in a feedback survey powered by REVIEWS.io via email. Each submitted review will be automatically entered into a monthly prize draw to win a £50 Mii Cosmetics gift card.

19.2 The monthly prize draw is open to UK residents aged 18 and over who have made an online purchase through www.miicosmetics.com and submitted a verified review via REVIEWS.io. Excluded from the draw are employees, individuals directly associated with the promotion, and any person who has won the prize within the last 12 months.

19.3 The £50 gift card is non-transferable, non-refundable, and cannot be exchanged for cash. The gift card is valid only for purchases made on www.miicosmetics.com.

19.4 The prize draw will be conducted on the 1st of each month (or the nearest Monday), with the winner notified within two weeks by email. The winner will be randomly selected from all reviews posted to REVIEWS.io during the preceding month. If we are unable to contact the winner within 14 days of the draw or if the winner is unable to accept the prize, we reserve the right to choose an alternate winner under the same terms. The outcome of the prize draw is final and binding.

19.5 We reserve the right to remove or reject any submission at our discretion, and any rejected reviews will not be included in the prize draw. By submitting your review, you agree to be fully responsible for its content.

19.6 We may cancel, modify, suspend, or terminate this promotion in the event of unforeseen circumstances or technical issues beyond our control, without liability to any participants or third parties. We also reserve the right to disqualify or withhold the prize from any entrant who, in our view, has not adhered to the spirit of these terms and conditions or the purpose of the promotion.

19.7 By entering this competition, all participants agree to be bound by these terms and conditions and to cooperate with any publicity or marketing efforts that may involve the use of their name or image on our website, emails, magazines, or mobile platforms at any time.
